DVLA Petition- Action for Diabetic Drivers

Hello,

My name is Helen and I have been a type 1 insulin dependent diabetic for the past 18 years. I am on an insulin pump and have excellent control of my diabetes. My Hba1c is good at 51mmols, and I have full awareness of hypo's. I am also a community nurse and use my car for work to get me around to see my patients as needed, therefore I particularly monitor my levels very closely due to driving.

In June 2014, I suffered two hypoglycaemic episodes during the night time whilst I was in a deep sleep. This was a very unusual occurrence for me and was caused by a sudden increase in temperature whilst I was also under a large amount of stress trying to work full time hours whilst completing a stressful university module. I did require assistance from my partner on both occasions and they occurred within a week of each other. Following support from my Diabetes Specialist Team my basal rates were adjusted and I had no further episodes, my consultant luckily also put in writing that he was happy for me to continue to drive as I am very vigalant at checking my blood glucose levels and monitor them as per DVLA guidelines before driving.

When reapplying for my Driving Licence as normal, I ticked yes to the box which said that I had required assistance from another person to treat two hypoglycaemic episodes within the past 12 months. There was no room to go into details around the context of these hypos and so I attached a letter with my application. On the 21st October I recieved a letter stating that my licence had been revoked on the basis of these two hypo's. When I contacted the DVLA they advised me that they did not need to contact my GP or Consultant to look into my medical records and I automatically no longer met the driving licence criteria. I find it both ignorant and discriminative that the DVLA do not consider these factors as diabetes is a complex condition to manage and if a Consultant thinks someone is medically fit to drive then their professional opinion should be taken into account. After lots of research and letters to raise awareness of this problem it is clear that this rule has come from the EU legislation brought into place in 2011.

I am currently in the process of appealing to the DVLA to try and get my licence back. However, I felt that even if there is minimal chance of me not getting my licence back that i simply could not just sit here and do nothing. I think its grossly unfair of the DVLA to revoke a driving licence on just 2 hypos per year that have required assistance from someone else giving a glucagon jab or force feeding hypostop etc. 3 hypos yes but not 2 as many people might think that there was a reason for the 1st one like too much alcohol or incorrect carb count for the insulin and that it wont happen again but when it does, most people get to and realise that theyve got to do something to tackle the cause so that 3rd party help wont be needed, but in fairness to the DVLA, the wording on the DIAB1 form has been changed to include .......was offered 3rd party help but didnt need it so no need to mention.

Yes I agree with what your saying. It is good that the DVLA has adjusted the form, but I think some improvement should still be made for the person to explain the circumstances of these hypo's. As i'm sure in the majority of cases there is an explanation as to why this has happened and should be considered by the DVLA. The issue is that they are not checking medical records or liaising with Consultants or GP's who know the individual well and surely this has to be considered when making life changing decisions based around a medical condition. I hope they continue to make changes to the form.

A hypo when asleep is totally different to during the day when you are fully aware of the symptoms (assuming you are).
Unfortunately dvla stick to their black and white DRACONIAN guidelines and don't look outside of the box so to speak.
ask your nurse to write a report stating an adjustment to your medication has corrected the night time only issue.
and next time, tick NO!

Your right. There is a difference. Although in my case I do have full hypo awareness and usually experience hypos around 3.9-3.5mmols. Obviously I don't usually have hypos at night but under stress/heat it's different.

I am now unfortunately well aware of how the DVLA implement the new EU directive, and wrongly so by all accounts.

I'm currently appealing my own case but I'm hoping that then petition will help others . In 100% sure it won't help me but it will raise public awareness and hopefully move towards a change in the directive. I've been in close contact with the DVLA and Diabetes UK and there is a meeting with the EU to discuss the issue on the 20th November so things are happening behind the scenes

Unfortunately I wouldn't lie about my condition as I think it's important to look after myself and I see diabetic complications on a daily basis. However I am concerned that this directive will cause many unsafe drivers to not report concerns to their doctors or the DVLA.

Good luck with your appeal.
I'm sure a lot of people wouldn't have ticked 'Yes' unless it could be verified e.g.if an ambulance or doctor attended and it was recorded, so maybe honesty where DVLA wouldn't know any difference if you ticked 'No' is the best policy.Not that I'm advocating that of course.
Regarding hypos when you're asleep....I discussed this with my diabetologist a few years ago and he said if you have a hypo during sleep you should be able to wake up if you're hypo aware .The reason people don't wake up is if they aren't hypo aware.
Last time I had my licence renewed (due Feb eventually issued June) the reason given by DVLA staff was due to a shortage of staff (doctors?) they had a back log of forms that had to be seen by their doctors if certain parts of the application required further info from your GP/diabetologist.In my case it was because my doctor had added notes to support my application with no issues but because notes were added which my doctor thought would help my application it delayed the
reissuing.

Yes there is some debate regarding this and a fair amount of research too. I've heard both sides if the story and it is the first hypo I've had in 18- nearly 19 years I've not woken too so I don't think it is in my case. However if this is happening regularly I completely agree. As your aware when your stressed it may affect your blood sugars. Be interesting to see the outcome of the meetings on the 20th. Please share and sign the petition :) will keep you updated.

I lost my licence a couple of years ago because my GP put a tick in the wrong box on the medical form. Even though my GP admitted his error and wrote to the DVLA the same day it took me 6 months to get my licence back.I got my MP involved who wrote to them 3 times, I got a letter back off some big wig at the DVLA promising my case would be dealt with as a priority because of the delays which they admitted were there fault,in the doctor in the medical dept refused and said I was in a queue and would have to wait. I live on my own and had no other form of transport life was difficult for six months. You have my total sympathy, the DVLA medical department are a law unto themselves. The one thing I learnt from this was when it comes to diabetes, doctors, consultants and the DVLA is, always lie, the truth gets you nowhere.

That sounds like a nightmare! It's so awful that they do this to us, and then take months to sort out their own mistakes!

I also find it wrong that individuals have to resort to hiding the truth, in fear of losing their licence, even when they have done nothing wrong. It makes me so mad and disappointed that our government could do this to people.

Hi everyone, just had my licence revoked (3-11-14) and have spoken to DVLA and my specialist. Not a lot of successes so far. 2 hypos within a couple of months.One a syringe problem and one a diet/insulin problem. Neither whist driving!! Both now resolved!
As a type1. for nearly 57 years and now aged 59, had no "severe" hypos for 30+ years and I've been driving for over 42 of those. At present I am a carer for my 90 year old mother (a type2.) but I really must find a way to overcome the stupid and short sighted bureaucracy that the DVLA and our government have. I've signed the petition and hope this helps.
It took me about 6 months to get my original licence and, any and every time I've dealt with the DVLA, it's been the same hassle. I too, do not wish to lie because I was taught it is wrong but whom for? Everybody in a position to make a "relevant decision" is petrified about being "responsible" IF something goes wrong, we need to get out of this "blame culture" and take responsibility for our own destiny!
Oh yes, and by the way, I race, as a driver, an historic saloon car, when I get the chance, at weekends (mother permitting) and non of my fellow competitors have any qualms about competing against me a type 1 diabolic (only if I beat them).
I have one very serious question though
does anybody know why "porcine" insulin production has stopped and/or is not being prescribed on NHS and why did its "disappearance" co-inside with the appearance of DAFNE being pushed in treatment clinics, I was doing fine before? Maybe it's to do with money?
Since both of these occurrences my personal control has been difficult and complicated. Anyone else?

I'm so sorry to hear that you are in a similar situation to myself. I completely agree with you that it is incredibly short sited of the DVLA/UK government to apply this restrictive guidance on diabetics without considering each case individually and to do that they must contact the patients Consultant and or GP.

Thank you for signing the petition, I hope that some day it may, make a difference and help towards changing this riduculous guidelines. I would urge you to contact your MP and MEP and express your concerns about your own problems. I have done so myself and this was how I was informed that a meeting was held yesterday with the EU and REFIT to discuss such concerns. Your MEP/MP should be able to get hold of the minutes of the meeting and let you know what the next step is. I wish you luck in your appeal, please do keep us updated!

I'm not 100% on why "porcine" insulin has been stopped now on the NHS. But I do believe that reaction is more likely to occur with Porcine insulin and many manufactures are starting to stop producing this type of insulin because of this and the new developments in insulin which mean peak values and length of action can now be more specific. Perhaps this is the reason why and not due to the cost? Might be worth discussing it with your Diabetes Specialist Nurse.
