A little bit of advice if possible.....

Hi, I have been employed for just under 18months with my current employer, I have recently started carb counting in preperation to getting fitted with a pump,in the last 3 months I have had 2 hypos at work, I have reduced awareness, and the company seems to have been very helpfull ( much better than last employer), I work with rotating machinery, the last 'hypo' was one with very rapid onset and no warnings, when ambulance tech took a blood test it was still 3.8, which is usually not into my 'hypo' zone (usually around 3), after this, the company suspended me on full pay pending medical reports from consultant and occy health, have been on suspension for 8 weeks and was asked to a meeting with management, during which they have said that I was to get 'signed off' by GP so they could put me on SSP, starting from 1st Feb,

Now my question is.......

1 can they do this( as in not pay me the 4 week @ full pay + 4 weeks 1/2 pay as I am contractly entitled?) as they are saying they have already paid 8 weeks @ full pay?

2At the meeting they stated that the wish to continue suspention on medical grounds, but it being on SSP, I thought you were either suspended, OR medicaly signed off, you couldnt be both....

The thing that concerns me is the GP will not sign me off as in her opinion it seems like company is trying to get out of paying me, but for her to sign me off there needs to a plan in place to attempt a resolution....its has been said that pump fitting will not be made until April at earliest, then in use for 1 month after fitting to ensure that all is 'correct' before resuming duties.

any advice on this would be appreciated as,as you can imagine, its all a bit of a nightmare

I don't know anything about employment law, but I'd recommend you contact Diabetes UK,
Look on their website for the phone number. they are the experts in this kind of thing.

Hello Bob,

I am not sure any of us on here are up-to-date with employment law. What I would do in the first instance is to contact your local citizens advice centre, and ask to make a appointment with someone regarding your current situation.

I appreciate it is a nightmare, but you would be wise to seek profesional advice. The only advice I would suggest is that you keep notes of all correspondence, and dates and times of all meetings and phone calls between you and your employer.

All excellent advice from Nigel.

What I would add is do you have legal expenses cover with your House Buildings and Contents Cover.

If so speak to them urgently as your situation should be covered and you can have the services of an Employment Law Specialist. That, as Nigel said is what you need. It is a minefeld for the unwary and I wouldn't dream of trying to offer you advice other than what has been said here.
