I wondered if anyone can explain to me whether as a Type 2 Diabetic on medication (Metformin and Gliclazide) I am covered by the DDA - everywhere I look for info on the DDA it seems to differ some say just Diabetes, some say Insulin dependant Diabetics, and as many people, I am confused - I do not have any problems with my employer I just wanted to know for my own benefit - Thanks in anticipation for any help on this.

I was working for a major DIY chain when I was diagnosed and put on metformin. I hadn't had a day off sick for 3 years before being diagnosed. Subsequently had a couple of odd days off and started getting stick from manager. I asked HR to check and they came back and said I came under DDA. Shut manager up!

Have been looking into it abit more and it seems to be a very grey area, Type 1 are definately covered and Type 2 on diet only are not but Type 2 on Medication maybe and may not depends on the individual case.

This is the reason why anybody thinking of using the DDA route when having problems with Employer's should always get expert professional help.......the law is a minefield for the unwary. There have been individuals before who came unstuck because a particular section didn't apply to them. As you say, it is definitely a 'grey' area. Some you might win....some you could lose.

We are all just Diabetic's here and can give our opinions about what we think or what happened to us in our particular set of circumstances but that is not the same as a proper legal answer. Sometimes even the experts can get it wrong........big time !

We do not......as far as I am aware have any Emploment Law Specialists on this forum. So, take any answers as a guide........not fact.

I was sent to Occupational health because of inability to concentrate at work due to my type 2 diabetes. It was stated that I would likely be covered by the Equality Act 2010. Hope this helps

I doubt if any of the other posters are around, as the thread is over seven years old.
