You won't get a 'Penalty Notice' unless one of your prescriptions is picked up by the random checking system.

Have you applied for a new certificate yet?
i just paid for prescription and they have waived the penaltry.as adviced on hereto do.approx 8 pounds.but had to argue the toss.

my card arrived today after18 days waiting and 15 days of having a prescription put in at the Dr,s which I couldn't/wouldn't pick up.

Luckily I,m on my last BP tablet tomorrow so will pick it up then.

No doubt I,ll still recieve a fine which I will not pay. Have you read
andybates e-mail? Worth a shot at calling them saying what he did
my fine got waived after paying the prescription but put up a fight.

The Health Minister Dan Poulter has committed the Government to changing the system for checking free prescriptions to stop people with diabetes being unfairly fined.

In recognition that many people with diabetes are falling foul of the system, Mr Poulter has asked the NHS Business Services Authority to change the process so that fines will be cancelled if people submit a valid application for a medical exemption certificate within 60 days of being contacted. He has also agreed to do more to let people with diabetes know that they need an exemption certificate........

Very typical for this govt. - Don't put any thought into new policies/regulations - just launch them on the public and wait to see if they are accepted but if there are too many complaints then think about an alternative approach, otherwise leave it as was.

Yes it wasn't well thought out, but in fairness at least the Health Minister has stepped in and taken action.

I picked up my prescription this morning and was asked to produce my card, not often I've had to do this.

I think they learned this approach from Microsoft. :)

as long as we are given immunity of back dated prescriptions and refunded any fines.
I no that an apology would be out of the question for being labeled as cheats.
but 1-0 is all we needed

I agree it's great news. But so far they are just saying no new fines. Nothing about those who have already paid fines. Nothing about people forced to pay prescription charges.

I think it a good idea .if on one from now on pays for anything, prescription or fines
we won the battle but maybe not the war .
but they have made it so much easier to fight anything they throw at us.
They have admitted that they have been unfair.
Only in a roundabout way.
But you cant trust any of them

Just to add to this, I have never had a certificate and just assumed that as the only reason for insulin was to treat diabetes there would be no need to get one. I have been T1 since 1983! No one has ever said a thing to me about this.
I suppose I will get one sorted now but this does seem like bureaucratic nonsense really and one of the many ways in which the NHS could save itself some money by reviewing processes.
For example when registering with a new GP I have to see the nurse before I then get to see the specialists at the hospital etc. The nurse often knows less than I do about T1 so why can't the GP just refer me directly? Sorry to derail the thread a bit but stuff like this annoys me



Hi I had this too!! No one ever told me I needed a certificate and the pharmacist just used to ask me if I had diabetes and signed it for me. I argued it all the way wrote a big letter saying how disgusted I was and his they were intimidating and bullying medically the medically ill and they shortly dropped the fine! Good luck! I know the NHS are struggling but they are targeting innocent people when they should be out catching the real frauds.

so do i continue to pay as im a T1 for 38 years i was 14 years old i was fined 174 pound in november and im paying my fine in instalments i do now have the exemption card but the chemist never asks me for it any advice welcome

Please do not take this approach.

If you know you need a card but refuse to obtain one - just to play devil's advocate - it may backfire on you. I can see Pharmacists in England being asked to view the medical exemption card before supplying your prescription and if you do not have it - you may have to pay for the prescription up front.

Everyone reading this thread now knows that they need a valid medical exemption card in order to claim free prescriptions - it is foolhardy *not to obtain it or check that it has not expired - just to see what will happen.

Yes if someone does know that they have a card that has expired, but they continue to tick Box E, then that is technically Fraud. It is only technically not Fraud if someone did not know that their card had expired at the time that they ticked Box E.
i.e. in the former case it is not possible to claim no wrongdoing without lying, but in the latter case it is possible to claim no wrongdoing ..... "if you can show no wrongdoing" is the wording the NHS BSA uses on their website. .

It must be even easier to claim no wrongdoing, for those that have never had any certificate, due to failure of all medical professionals and pharmacists to advise or request sight of card, over many years.
