Legally, they need to be informed that they need to do this because there's a requirement for public notice. Technically, it's illegal to carry a plank or ladder in a Metropolitan Police District, but if you think a builder deserves a fine for not knowing that then I can only hope you're not in...

It's not 'Ignorance of the law', it's 'mistake of fact', which is indeed a defence in law. There's also a requirement for public notice if there's a change, which there was. You were not reasonably notified, or indeed notified at all, about the change so you're off the hook due to their...

No, you needed one before 2002, but it was issued once and didn't expire. A reminder to renew was sent out only to people diagnosed after 2002.

I know, right! I had a letter lined up demonstrating how their actions were illegal, but am rejigging it today so it becomes a prelegal.

I know what basis they think it is, but they happen to be wrong about it. That's why it's so weird - 'I'm going to give you free medicines even when they're not for diabetes, but put a foot wrong and I'll fine you £150, take you to court and wreck your credit rating' is the stuff of abusive...

They sent me a letter specifically threatening my credit rating.

    Type 1: Prescription fine

Yes but it would have been issued once and that was it. Even so, they have never had the legal right to raise this fine without proving knowing deception. They should make it a blanket exception, repay the money they have wrongfully taken and apologise for their letters threatening people's...

    Type 1: Prescription fine

I replied to this earlier, but the mods appear to have taken down my useful answer. Type 1s used to have blanket exemption just like the over 60s and under 16s until 2002, when some bright spark made exemption renewable every 5 years. They didn't tell existing certificate holders, only those...

The response from your MP will be that the minister cannot act, You have a right to fight this. Tell them about your circumstances and ring repeatedly until you get the result you want. Pasted from below No, the rules changed in 2002, but they didn't inform people who used to have blanket...

Get a card while we sort this out. Pay for your prescriptions before it arrives. Forms available from your GP, usually on the front desk since this nonsense hit the BBC. Also, keep ringing them persistently. Quote the law at them. Point out again that this could be the basis for a civil suit...

I'm personally disappointed in the diabetics who think the BSA is in the right. Moreover, the system needs to revert to its pre 2002 exemption. In the meantime, make sure you get your stupid form to confirm you haven't experienced a miracle cure >( Edited to conform to forum rules. Name...

No, the rules changed in 2002, but they didn't inform people who used to have blanket exemption before that point. In 2002, the info wasn't available online, so they'd have had to write speculatively to DH to ask if an irrational rule change had occurred. Diagnosis before 2002 would mean they...

    Type 1: Prescription fine

It's worth diabetesUK going to court for, like the RSPCA do in animal abuse cases. It's worth standing up to because it's an illegal charge. I personally can easily afford the charge, but understand the impact of it on low income households (devastating) when no legal wrong has been...

    medical exemption card

Well, wouldn't it be reasonable to assume that 'valid' medical exemption would be based on having an incurable condition rather than having to prove an incurable condition hadn't cured itself in order to get a 5 year certificate? It would be like seeing a roadsign with '20' written on it, but on...

The situation shouldn't have arisen in the first place. Should it ever come up, say in 5 year's time, this might be helpful http://www.legislation.gov.uk/ukpga/2006/41/section/194

    medical exemption card

@ducati2242 and @CarbsRok actually the law governing this requires you to knowingly deceive, which you didn't, and the form only requires payment if you weren't entitled, which you were, so CR don't defend a bad system - as you say, the Nhs' ignorance of the law is no excuse!
