"Both ESA & PIP assessments can badly fail clients with mental health problems. The standard report response is usually "good rapport and eye contact, no rocking movements, looked well-kempt, etc etc".
At our local CAB we are fortunate to have funded caseworkers to help clients appeal benefit decisions. To give an indication of the standard of these assessments, it is common for a tribunal to overturn the DWP decision and for the client to get an award at tribunal even after 0 points at assessment.
The impact on the client can be devastating, clients can suffer mental health crisises. They certainly are less likely to move towards recovery and get back into a position where they can start to contribute towards society again.
The appeal process now two stage and more difficult, after the mandatory reconsideration (at which the decision is rarely changed by the DWP), the client has more paperwork and deadlines to face in order to continue the appeal to the Tribunal Service.
I hope Michael manages to return to his CAB when he receives the mandatory reconsideration notice, as the Tribunal Service are very thorough. I would estimate that around 90% of the appeals in our local CAB where the clients is helped by a caseworker are successful.
