Hello and on the scrounge for advice.

Hi all.

Sorry to make my first post a question but am after a little advice for my father in law.

He is type 1 and has been for many years. About 5 years ago he took out a loan and had payment protection insurance (PPI) as the bank recommended it. Last August he had an accident at work which caused an injury to his toe. This injury became an ulcer which then became a diabetic ulcer. When he injured his toe it did become quite swollen and he was signed off work (he is self employed) so he claimed on the PPI and they paid out each month until December when they decided to stop payments and said my FIL had to start paying as the ulcer was caused by diabetes. the argument has continued until last week when the bank has said that he has to make the payments AND pay back the money they have paid on the insurance. Now we realise that diabetes is not covered on the PPI cover, but our argument is that diabetes did not cause the injury to his toe....the accident did, but diabetes only made the original injury worse. I was just wondering if anybody had any advice.

If they do not change their opinion then we are looking to make a complaint into being mis-sold the PPI as it would be invalid no matter what injury had occurred.

When I took out my mortgage-about 4 years ago-I was told that I couldn't have PPI, BECAUSE I was diabetic. It sounds like he has been mis-sold the PPI. Also, I'm pretty sure that the bank can not ask him to pay back what they've paid out! What a cheek! Threaten the ombundsman-that always works when my bank try it on-they always back down.

Hi, you said the he was self-employed, generally if you are self-employed you can not take out PPI, so it looks like miss selling on several grounds, th at is, did he tell them that he was self-employed when he first had the insurance?

Geoff, he wasn't self employed when he took the loan out he got made redundant and decided to start his own business, although he didn't claim on the PPI in the mean time (like a fool) but to be honest I don't think the bank asked him about it, so it could be a little bit more ammunition in the battle.

It is quite interesting regarding Tasha's comment as when he took out the loan, he also wanted to take life assurance out but they said he couldn't because of his diabetes. This was at the same meeting he had regarding taking the loan out so they knew he had a pre-existing condition at the time.

I have advised him to get a half hour consultation with a solicitor tomorrow and I think a few calls to the ombudsman will take place.
