Legal advice on used needles

Hello

Wondering if someone has come across this experience before.

I have just been told by the holiday park I stayed at 6 weeks ago that I left an already used needle within the accomodation and a cleaner has touched it, and pricked herself. She has asked to contact my gp for my health records which I have given consent to. Im usually so careful as to where I keep my used needles so really dont know how this could have happened. However now it has, I'm worried she could sue me. I'm positive there will be no health implications for her but still worried nonetheless.

Does anyone have any legal advice or experienced something similar?

I don't have any legal advice but suggest that you have a duty of care to everyone to ensure that they cannot be injured by your needles used or otherwise. In this litigious age it is wise to be careful.

Do you know where they found the needle and when that area was last inspected, before the accident?

Where did the request for access to your medical records come from?

I'm not a lawyer, and folks might have a view on this, but nobody is able to give you legal advice. If anyone does, please report them, because this is not what we're here for.

If you have concerns, you could consider contacting Citizen's Advice, or a brief consultation with a lawyer. Many lawyers will do an initial consultation without charge.

Can they prove it was yours, or even show that it’s a diabetes needle? Could have been left there by another guest...
 
Questions I’d be asking in your shoes as opposed to legal advice (sorry)

Along with when it was previously inspected, when after your leaving did the incident occur? Who and when was it reported to? Who else had access in the meantime? why did it take 6 weeks to contact you? Why would they have suspected you? Did they know about your diabetes? How? I’d also be prepared to demonstrate what precautions you take for safe disposal (as you atest to in your post) to avoid allegations of recklessness as if it was indeed your needle (can they prove that? Have you admitted that? In what form?) it would have instead been an unlucky freak accident

I doubt citizens advice would be able to do anything other than refer you to a solicitor so should you need this the brief free consultation where you outline the situation and they tell you how they could help and importantly how much it’ll cost would be the next step. I’d go to a specialist not an all rounder.
