Is this a defence
no intent to deceive
I stole this from someone else sorry.
GUILT MY LORD

Is there any ...lawyers out there
or are they all working for NHS business dept

If it happened to me, I would be feeling so mad, and I would fight all the way as far as I could.

Best wishes RRB

Unfortunately ignorance is not a defence in the eyes of the law, but a judge might go easy on the sentence due to it.

I think you need to do a bit of googling because this whole affair is receiving a lot of criticism and not necessarily good for the organisation dishing out the fines. http://www.bbc.co.uk/news/health-30622544. I think it is very definitely a case of the punishment not fitting the crime and the shame is even the pharmacist is now expected to police this when all he/she has is your word when you sign the back of the prescription. When that prescription is for something that provides exemption it beggars belief that you then need a certificate. A prison sentence is an option because they don't pay prescription charges and don't have exemption certificates either.
