This is the reason why anybody thinking of using the DDA route when having problems with Employer's should
always get expert professional help.......the law is a minefield for the unwary. There have been individuals before who came unstuck because a particular section didn't apply to them. As you say, it is definitely a 'grey' area. Some you might win....some you could lose.
We are all just Diabetic's here and can give our opinions about what we think or what happened to us in our particular set of circumstances but that is not the same as a proper legal answer. Sometimes even the experts can get it wrong........big time !
