Claiming PIP Benefit

I am almost 65 years old and I've had type 1 diabetes for 62 years. I also have diabetic neuropathy, angina, and arthritis. In December 2021 I was advised by my Welfare Co-ordinator that I should apply for PIP benefit. I did apply and I was refused. I then asked the DWP to have another look at my application. Again I was refused. I submitted my appeal in July 2022, and I am still waiting for a court date!! This whole thing has been going on now for 15 months and I'm beginning to feel quite stressed and anxious. Has anyone else had a similar experience, and can anyone give me any advice on how to state my case, if I ever get a court date that is.
 
You cannot claim PIP, when you reach pension age. So hoping you get it backdated if you don't get a court hearing in time.
It will come under pension benefits.
My wife win her court case v government to prove her disability.
Have citizen's advice been involved they are brilliant?
I tried for pension credits, but was knocked back.

Remember it is on your WORST day.

It's a common trait to struggle , almost as if proving why we can't do something, but sadly even attempting can tick the box "can do successfully" or so it seems.

A friend, clearly incapacitated, was asked to show how he accessed toilet.

Manfully gripping walls, sofa, furniture & eventually got to the loo.

Pip ended.

And don't expect the person to be an expert in your illness etc

Believes, a dentist was mentioned..mmmh.


So if doing the test for first time.
Be honest about how BAD it is.

They themselves say it's your WORST day.

I had some dealings, horrendous crash, multiple breaks.

Constant pain most days, nothing excruciating in the main, but it can stop me doing things, and force me to suddenly stop walking when it's severe

Silly boy, I got marked down, because I sounded like I wasn't in pain, while talking on phone.

Wishes I had winced or whimpered once or twice rather than manning up :rolleyes: :banghead:

Yes, can't apply for PIP when of pension age. But can apply for Attendance allowance.
 
I'm not sure but I think if there are certain conditions it can be paid. Again not sure worth getting in touch with CAB. My hubby gets PIP but he really had to to fight (with the help of MIND and CAB) he waited 10 months for his appeal whilst appealing his industrial injuries, which he ended up getting a lifetime reward after the dwp said he didnt have condition!

Attendance allowance is not means tested but also quite difficult to get now. The rules are far more like PIP. You receive PIP or DLA if received or applied before retirement. It then continues. There is a list of illnesses and conditions which they have. I have been disabled since 1990 but have never managed to get it!!! As yet haven't applied for AA. yet although need it.
 
Attendance allowance is not a means tested benefit.
That is the one I got knocked back on even without an assessment with the list of conditions below.
I enquired on the phone if I could get help if after I have surgery, which would put me in rehab and rest for two months or more, because the doctors want to fuse the discs in my neck. He said, I probably wouldn't because I'm not disabled enough!
I told him that I'm a carer and I would need help with the wife. Computer said no!

Attendance allowance is for help for the claimant, not for their families, that is pension benefits. That is a means tested benefit.
 
Remember, it's not about which conditions you have but the effect those conditions have on your life. As others have said, don't assume that the person making the judgement understands what's it like to have any of your conditions; you have to explain it. And you explain and demonstrate it based on your bad days, not your good days.

It's also important to be open about the mental toll it takes on you because that's an important part of how you are affected. E.g. don't tell them that on a good day, you can sometimes put out the rubbish bins for collection. Tell them how frightens you to even try to put out the rubbish bins because you're so unsteady on your feet... and so on.

Attendance Allowance is not means tested - savings etc don't get effected. I only know because my of my late dad. However it may have changed by now best check with CAB

Honestly the things that have to be spelled out - I understand why but sometimes is reduces me to tears when I look back and see what people have had to go through just to get some help.

I wish I had any advice but I had to give up trying a couple of years ago although my symptoms are similar to yours though I'm only 52 atm.I was thinking of trying again but reading your awful saga,I'm feeling deflated.Best of luck though.
